Prodajna pogodba, sklenjena med prvo in drugo toženko dne 22. 8. 2017 prikriva mešano (prodajno darilno) pogodbo, pri kateri je zaradi močnih subjektivnih prvin kavze tožnikova predkupna pravica izključena. Ker tožnik ni tretja poštena oseba, ne pride v poštev uporaba tretjega odstavka 50. člena OZ .
