Ob pravilni uporabi zakonskih določb je bil delodajalec tisti, ki je moral ob izplačilu odpravnine v primeru upokojitve za tožnico obračunati davke in prispevke in jih v predpisanih rokih tudi plačati. Izhodišče za ta obračun je bil glede na tožničino pogodbo o zaposlitvi seštevek njenih bruto plač. Stranki bi morali v pogodbi izrecno določiti, da tako dobljen znesek predstavlja čisto izplačilo tožnici oziroma, da mora tožena stranka ta znesek še posebej obrutiti in za tožnico obračunati in plačati še posebej tudi davke in prispevke.
