Iz besedila določbe 77. člena ZDavP-2 izhaja, da nelistinski dokazi, kot npr. zaslišanje stranke ali priče niso izključeni, na kar kaže dikcija navedene določbe, da se trditve „praviloma“ dokazujejo z naštetimi listinskimi dokazi. Možnost dokazovanja z drugimi dokaznimi sredstvi pa je predvidena ravno za primere, ko listinskih dokazov kot primarnega dokaznega sredstva ni ali je nepopoln. Vrsta dokaznih sredstev je odvisna od narave spora. Zavrnitev navedenega predlaganega dokaznega predloga je davčni organ v konkretnem primeru utemeljil s sklicevanjem na verodostojne listine (na pisne dokaze) in s tem posameznim vrstam dokazov dal pomen, ki iz ZDavP-2, ZUS-1 in Zakona o pravdnem postopku (v nadaljevanju ZPP) ne izhaja, s čimer je sprejel vnaprejšnjo dokazno oceno.
