ZDavP-2 v 5. členu davčnemu organu ne nalaga, da mora po uradni dolžnosti iskati dejstva, ki so za zavezanca ugodna, saj je dokazno breme v tem pogledu v obravnavani zadevi na zavezancu. Zavezuje ga le, da se z ustrezno obrazložitvijo izreče do navedb, dokaznih predlogov in izvedenih dokazov, kar sta, kot že navedeno, davčni organ in toženka v obravnavani zadevi tudi storila, s čimer se strinja tudi sodišče. Če zavezanec sam zatrjuje obseg premoženja, to pa je lahko dejstvo, ki davčno osnovo povečuje, in je davčni organ takšno zatrjevanje sprejel (se z njim strinjal), dejstvo postane nesporno.
