Pri tem je treba v primeru, ko obveznost plačila NUSZ neposredno bremeni najemnike, upoštevati tudi, da je v nekaterih stavbah več stanovanj oziroma več poslovnih prostorov, ki jih lastnik ali lastniki oddajajo različnim najemnikom, pri čemer vsi najemniki uporabljajo isto funkcionalno zemljišče objekta, bodisi za dostop, bodisi za manipulacijo oziroma za druge namene, za katere se funkcionalno zemljišče uporablja. Če je temu tako, plačila NUSZ ni mogoče naložiti le enemu, ampak v ustreznem deležu vsem, ki ga (na podlagi najema) uporabljajo oziroma lastniku nepremičnine.
