V upravnem sporu tožeča stranka izvršilnega naslova ne more izpodbijati. V postopku davčne izvršbe je bistveno le, da je izvršilni naslov postal izvršljiv, kar v obravnavanem primeru ni sporno, zato so tožbeni ugovori, ki se nanašajo na izvršilne naslove neutemeljeni. Sodišče v postopku davčne izvršbe presoja le, ali so izpolnjeni pogoji, ki jih določa ZDavP-2, ter ali ima sklep o izvršbi sestavine določene v 151. členu ZDavP-2.
