Tožena stranka vrednosti premoženja ni ugotovila na način določen v 6. in 7. členu Pravilnika o ugotavljanju prihrankov in premoženja ter o vrednosti zagotovljene oskrbe v postopku za dodelitev denarne socialne pomoči, ker pred izdajo izpodbijane odločbe ni ugotavljala dejstev, zaradi katerih se vrednost premoženja lahko ugotovi po 7. členu Pravilnika. V izpodbijani odločbi ugotovljena vrednost pa ne temelji niti na izjavi tožnika pač pa le na splošnem podatku, kar pa za ugotavljanje pravno pomembnih dejstev ni skladno s pravili splošnega upravnega postopka.
